Apollo’s Final Warning…

This is your last opportunity to refund the full $4,100 for the fraudulent work you performed on my heating and air conditioning system before I devote my considerable spare time to making sure that all appropriate government agencies and consumer organizations are aware of your fraudulent business practices.
Already, potential customers can search for your company name on the Internet and easily find the full and true story of your fraud, including your attempt to switch de-installed parts, your attempt to impair the function working equipment in order to charge for un-needed services, and your failure to refund funds on a canceled contract — not to mention the details of at least eight code violations! Even a reporter for SmartMoney, The Wall Street Journal Magazine saw the stories and has recently contacted me because he was looking for “victims to insulation fraud or anything related to home heating maintenance, including furnaces” for an article.
You made a mistake when you ripped me off! Most of your victims can merely groan about how you overcharged them and are powerless to do anything about it. Picture ABC sports reporter Michael Francis who, on October 10, 2005, you charged $970 for an hour’s work and a $180 part — his only option is to accept your immoral and unethical response that you can charge whatever you want for your services. I, on the other hand, successfully preserved my consumer rights by canceling the contract within the grace period allowed by law. Fortunately for me, YOU FAILED TO PROPERLY INFORM ME OF MY RIGHT TO CANCEL AS REQUIRED BY LAW, so any perceived waiver of that right is invalid!
If necessary, I am very willing to take a sojourn into a court of law which will have no option (thanks to my well-timed act of self-preservation!) other than siding against you! Wouldn’t you rather avoid that waste of time and resources to you and your company? It is in your best financial interest to ensure that the final chapter of the story that I tell everyone (including reporters and the public in general) has a happy ending for me. And the only way that will happen is if you refund the full $4,100 immediately.
I am giving you a deadline of 5:00 pm on Saturday, December 24, 2005, by which time you must call me to inform me of the pending refund, AND my credit card company, Citibank, must be able to inform me that you have already authorized a refund of the full $4,100 — otherwise, I will continue to pursue other legal options and Santa Claus will be delivering very special packages to the Contractors State License Board, the Better Business Bureau, and several Bay Area consumer protection organizations…

Please post/send update - where are you now - did the contractor do anything? Have you filed suit? Am curious - am in same situation. Would like to know though about the 10% down requirement is I thought this was not a requirement until Jan 2006 FYI - beware of Dunn-Rite Construction - ACI Development in Hemet CA and Los Angeles CA!
There are enough people complaining about this guy. Why don’t we get together and make it difficult for him to continue to rip people off. We should be able to do something as a group that we cannot do alone.
